On 28 December, 2009 for the second time Medvedevo District Court of the Republic of Mari El invalidated the refusal of the Ministry of Finance of the Russian Federation  to pay 20 000 rubles to Iskandar Shaehov and Aleksey Yanagaev and obliged to pay the above-mentioned amounts to them.

We remind you that on 14 April, 2009 Aleksey Yanagaev and his son Iskandar Shaehov were detained by Medvedevo district prosecutor’s office of the Republic of Mari El and imprisoned. In April of the same year they were accused in committing a particularly serious crime – a murder. Then, the period of detention was extended several times, but on 21 September, 2005 criminal proceedings against Shaehov and Yanagaev were terminated in connection with their innocence.

The men have achieved the payment as compensation for moral damage caused by unlawful prosecution.

They have addressed to regional public organization “Human being and Law” in order to receive the amounts, spent to the legal assistance. In judgments of 16 December, 2005 (and then in the judgment of 20 January, 2006 year) Medvedevo District Prosecutor’s office obliged the Ministry of finance of the Russian Federation to pay 20 000 rubles to Iskandar Shaehov and Aleksey Yanagaev. This amount was spent by each of them to legal assistance caused by unlawful prosecution.

However, the Ministry of Finance of the Russian Federation ignores the judgments of Medvedevo District Prosecutor’s office for four years and each time finds lame excuses not to pay the compensation.

Having exhausted all legal remedies at the national level and having the court’s decision about the inaction of the Ministry of Finance, Shaehov and Yanagaev filed a complaint to the European Court. The proceedings have been suspended in connection with the issuance of pilot decision on the case “Burdov against Russia 2″, and the European Court of Human Rights has given Russia a year to pay a just compensation to the men. On 20 January, 2010 the deadline expires, but the men haven’t received their money yet.
